1. General Terms and Conditions

Sportify NZ Ltd. complies with the NZ Consumer Sales Act. To place an order, a customer must be of legal age (18 years or older), or have the consent of a legal guardian with a physical address in New Zealand. 

2. Placing an Order

Placing an order for Sportify NZ's products is performed via our website www.sportify.nz. Received orders are confirmed by means of a written order confirmation via e-mail.
Sportify NZ Ltd. will consider an order binding only once an order confirmation has been received by the customer.


Sportify NZ Ltd. reserves the right to deny a purchase. All orders are considered binding. If you have placed an order in error, you are required to contact us immediately.
If an ordered item is out of stock, the product will be removed from your order. We will reimburse the amount pertaining to the removed item or we will amend the invoice.

3. Prices

All prices are stated in NZD and are inclusive of the GST. All prices are subject to  increases and other price adjustments beyond the control of Sportify NZ Ltd., who reserves the right to apply these. These are mainly freight costs from overseas. 

4. Payment

PayPal
We will take payment from your credit debit card via your Paypal account or you can pay directly with your bankcard. For further information about PayPal or to create a PayPal account please visit PayPal.com.

5. Delivery Times

Sportify NZ Ltd. cannot be held liable for the delivery of items that are out of stock or which have been discontinued. Shipping fees are always shown at checkout.

 

6. Delivery Delays

Should any delivery delays arise, we will, of course, do everything in our power to ensure that your order is delivered as soon as possible. As a customer, you have the right to cancel your purchase in the event of a considerable delay.


Situations may arise which make it impossible for us to fulfill an order, for example, if our suppliers are unable to fulfill their obligations to us. Sportify NZ Ltd. reserves the right to disclaim liability for restitution to customers in the event of such a situation or owing to delivery delays.

7. Shipping

Courier costs for orders to be sent in NZ vary on the size and location of the order. A small item is $5, a shoe box is $12 and any larger orders are $22. RD addresses have a higher rate with an addition of $4.50 to the original courier charge. 

8. Cooling-off Period/Right to Cancel

It is our hope that all of our customers will be 100 % satisfied with their purchases.  If you experience any problems with your product or are not completely satisfied, we urge you to contact us at info@sportify.nz


Sportify NZ Ltd. complies with the NZ Distance and Door-to-Door Act. We invite you to refer to this 60-day cooling-off period.
In the event of a return, as a customer you are required to send back the product within 30 calendar days from the date that you received the product. If the product is not returned within the prescribed time, the Right to Cancel is forfeited.

Products must be returned in their original condition and in their original packaging. If the quality of the product is affected due to you, as a customer, having handled the product more than is deemed necessary to inspect if it fits, we shall appraise the value of the product as having depreciated by 100 %. Sportify NZ Ltd. reserves the right to charge the customer for anything missing or omitted. The customer is required to pay for return shipping costs. Cash on Delivery returns will not be accepted. We will reimburse you as soon as we have received the returned product. Pursuant to NZ law, we are afforded 14 days to perform the reimbursement, but our goal is to do this as swiftly as possible.

9. Consumer Complaints/Claims

Sportify NZ Ltd. complies with the NZ Consumer Sales Act with respect to claims. Therefore, we undertake to exchange incorrect or defective products at no extra charge. Send an e-mail to info@salming.nz with a picture attached and explain the reason for the claim. This will facilitate the claims process.


Remember to never accept a package with visible damage or defects which may affect the condition of the item ordered. In such a case, register a claim directly with the UPS Access Point at the access point and request that they return the package to Sportify NZ Ltd.  along with a written reason for the return. Then send an e-mail to info@sportify.nz to inform us of the return.

10. Disputes

In the event of a dispute, we have a goodwill process and handle it case by case. 

11. Unclaimed Packages

If for some reason you don’t pick up your package, you must pay the cost of shipping and any freight charges. Unclaimed packages will be charged a fee. The fee is charged in arrears. If payment is not received claims will be forwarded to a debt collection service. No exceptions are made.

12. Security

We shall under no circumstances disclose personal data or information without the explicit consent of the person concerned. This also applies to e-mail addresses.

13. Reservation

Sportify NZ Ltd. reserves the right not to be bound by errors or inaccuracies with regard to website content or price lists. 

14. Personal Data

Sportify NZ Ltd. serves as the data controller for the information you submit to Sportify NZ Ltd. Data and information is stored securely and is protected in order for us to fulfill our obligations to customers and for marketing purposes.


An address and telephone number must be provided when placing an order. When opting to pay via invoice, your NZ personal identity number must also be provided.


By placing an order with us, you consent to your personal information being stored and utilized for the purposes of transport, payment and invoicing. Your personal information can be transferred to our payment partners PayPal, as well as our logistics partners so that these may fulfill their obligations.
You always have the right to ascertain which information has been registered. If this information is inaccurate, incomplete or irrelevant, you can request that it be corrected. You always have the right to unconditionally request that the information be deleted.
We comply with the NZ Personal Data Act and your personal information is never transferred to any third party.

15. Cookies

Pursuant to the NZ Communications Act, all visitors to websites must be informed if cookies are used. When you visit a website, cookies are stored on your computer. These cookies are referred to as Session Cookies and are used to track your login (if you are logged in) and your shopping cart when shopping on the website. Session Cookies are not stored on your computer for an extended period of time, but disappear when you close your web browser.
If you do not accept the use of cookies, you can adjust your web browser settings to automatically deny cookies or to inform you if a website uses cookies. However, if you disable cookies you will not be able to make purchases, as the shopping cart and login require the use of cookies in order to function. You will still be able to browse the web-store even with cookies disabled.
